From affecting legislation to affected legislation

Where an amendment or other effect has been carried through, a purple arrow appears at the appropriate place in the text of the affecting provision.

If the amendment comprises a block of text to be inserted or substituted, the arrow will appear at the beginning of that block of text. If the effect does not alter the text of the affected document, the link will generally appear before the words identifying the affected provision. But where, as in the example below, this is not practicable, it will appear before the words describing the effect. As this is a Commencement Order and the effect is that an amendment is being brought into force, the arrow is placed before the words ‘shall come into force’.

Example of an effect that does not alter the text of the affected document from the Regulation of Care (Scotland) Act 2001 (Commencement No. 2 and Transitional Provisions) Order 2002 (No. 162 (C. 8)) article 2

In repeals schedules, the link is placed at the top, usually against the word ‘Repeals’.

Where there is only one provision affected by the relevant words in the affecting legislation, clicking on the arrow will take you straight to the affected provision. If there is more than one provision affected, you will first be presented with a list of the affected provisions to choose from.

List of affected legislation obtained by selecting the purple arrow link from the Regulation of Care (Scotland) Act 2001 (Commencement No. 2 and Transitional Provisions) Order 2002 (No. 162 (C. 8)) article 2

When you navigate a link from the affecting legislation to the affected legislation, you will be taken to the version of the affected provision in which the effect was first recorded. For example, clicking on the first item in the list shown above would take you to section 11 of the Administration of Justice Act 1982, and specifically to the version current on 1.4 2002, the date of the effect.

Having navigated the link in the example, you can then go on to navigate to other provisions within the Administration of Justice Act 1982 by clicking on the ‘View contents of this legislation’ link near the top right hand corner of the page.

This will take you to a ‘Results within legislation’ page for the Act, at the top of which you will be presented with a facility to ‘Refine date/ extent’.

The reason for this is that, when you follow a link, the system is no longer constrained by your original search criteria. It is simply taking you to the provision version at which the link is pointing, whatever the date or extent attributes of that version might be. Therefore, when you want to navigate away from that version, the system invites you to specify date and extent criteria again.

The ‘Results within legislation’ that are now listed are those produced by the following date and extent criteria:

These values are pre-filled in the boxes of the ‘Refine date/ extent’ facility. If you are happy with those criteria, you can proceed immediately to select the provision, or higher level of division, at which you want to open the legislation from the results list below. If, on the other hand, you want to see the legislation as at any other date or extent, first change the values in the boxes as required and then click on the ‘Go’ button to refresh the page before proceeding to select from the results list.
